1. Introduction

Little Black Book App Ltd (SC655855) (“we”, “us”, “our” or “Little Black Book”) operates the Little Black Book platform at https://mylittleblackbook.app and related services (the “Platform”). These Terms & Conditions (“Terms”) govern your use of the Platform.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Definitions

  • Customer: A user who browses businesses, books appointments, and/or uses the Platform to find and receive beauty and wellness services.
  • Business: A beauty or wellness professional who creates a business profile, lists services, and accepts bookings through the Platform.
  • Prescriber: A user who subscribes to our Prescribes service to connect with qualified businesses who can offer treatments (e.g. prescription skincare, aesthetic treatments).
  • Appointment: A booked session between a Customer and a Business for one or more services.
  • Content: Any text, images, reviews, or other material you submit to the Platform.

3. Account Registration and Eligibility

3.1 General

You must be at least 18 years old to create an account. You must provide accurate, current, and complete information when registering. You are responsible for keeping your login details secure and for all activity under your account.

An account holder must be 18 or over, but a Business may treat clients aged 16 or 17 where a person with parental responsibility consents. Responsibility for obtaining and recording that consent rests with the Business - see section 9.3.

3.2 Customers

You may browse businesses and book appointments without an account, but an account is required to save favourites, manage bookings, leave reviews, and access your profile and booking history.

3.3 Businesses

Businesses must complete onboarding, provide professional details, and connect a Stripe account to receive payments. We may verify qualifications and identity. Businesses must hold valid insurance and comply with all applicable laws.

3.4 Prescribers

Prescribers subscribe to Prescribes (monthly or annual plan). Subscription is billed via Stripe and includes a 14-day free trial. You may cancel at any time. Refunds are subject to our refund policy.

4. Booking and Payments

4.1 How Booking Works

Customers select a business, choose services, pick a date and time, and pay at the time of booking. Payment is processed via Stripe. A booking fee may apply (typically 3.5% or as set by the business). The appointment is confirmed once payment is successful.

4.2 Prices and Fees

Service prices are set by businesses. We do not charge customers a commission on bookings. Businesses may set a booking fee percentage. All prices are in GBP unless otherwise stated and include VAT where applicable.

4.3 Tips

Customers may leave tips for businesses. A 3.5% platform fee applies to tips. The remainder is transferred to the business.

4.4 Refunds

Refunds for appointments are at the business’s discretion. To cancel, you submit a cancellation request through the Platform. The business will review and may approve a full refund, partial refund, or no refund. We do not guarantee refunds.

5. Cancellations

If you need to cancel an appointment, you may submit a cancellation request via your account. The business will review and respond. Refund outcomes (full, partial, or none) are determined by the business and their policies. Cancellation policies may vary by business.

6. Business Subscription (Little Black Book for Businesses)

Businesses may subscribe to access tools including: unlimited bookings, branded booking page, client management, automated reminders, business reporting, and support. We offer a 14-day free trial. Subscription terms and pricing are set out on the business landing page.

7. Prescribes Subscription

Prescribes is a subscription service (monthly or annual) that lets prescribers create a profile visible to qualified businesses. Businesses can find and contact prescribers. Subscription is billed via Stripe with a 14-day free trial. You may cancel at any time.

8. User Content and Conduct

8.1 Your Content

You retain ownership of content you submit (reviews, profile information, etc.), but you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute it in connection with the Platform.

8.2 Prohibited Conduct

You must not: post false, misleading, or offensive content; impersonate others; harass or discriminate; use the Platform for illegal purposes; attempt to circumvent security; or interfere with the Platform’s operation.

8.3 Reviews

Reviews must be genuine and based on your experience. We may remove reviews that violate these Terms or our content guidelines.

9. Data Protection

What we do with personal data, and why, is set out in our Privacy Policy . That policy is the full account; this section sets out the obligations each of us takes on, which the policy describes but cannot create.

9.1 Who is responsible for what

Different information on the Platform has a different controller, and the split matters:

  • We are the controller for accounts, the directory, bookings made through the Platform, payments, the messages we send, reviews, and the operation and security of the Platform.
  • For consultation and consent form data, we and the Business are joint controllers within the meaning of Article 26 of the UK GDPR. We determine how forms are built, stored, secured and made available; the Business determines what is asked and how the answers inform treatment. The essence of that arrangement is published in our Privacy Policy, and either of us will respond to a request from the individual concerned.
  • For a Business's own records about its clients - treatment notes, internal notes, and client details the Business enters or imports - the Business is the controller and we are its processor. We hold and protect that information on the Business's instructions and do not decide its content.

9.2 Our obligations to Businesses as processor

Where we act as a Business's processor under 9.1, and for the purposes of Article 28 of the UK GDPR, we agree that we will:

  • process client records only on the Business's instructions and as needed to provide the Platform, and not for our own purposes;
  • keep the information confidential, and ensure that our staff who access it are bound by confidentiality;
  • apply appropriate technical and organisational security measures, and record staff access to a Business's account;
  • engage sub-processors only where they are bound by equivalent obligations, and tell the Business of any intended change to those we use;
  • assist the Business in responding to requests from individuals and in meeting its own security, breach-notification and impact-assessment duties;
  • tell the Business without undue delay if we become aware of a personal data breach affecting its client records;
  • on the Business's written instruction, delete or return its client records, except where we must keep them to meet a legal obligation - booking and payment records for tax being the main example; and
  • make available the information the Business reasonably needs to satisfy itself that we are meeting these obligations.

9.3 Business obligations

If you are a Business, you agree that:

  • you are responsible for having a lawful basis for every client record you put on the Platform, including any client list you import from another system, and for having given those clients the information the law requires;
  • where you ask a client to complete a consultation or consent form, you are responsible for what the form asks, for the clinical judgement you apply to the answers, and for obtaining valid explicit consent where the form asks about health;
  • where a client is under 18, you are responsible for obtaining consent from a person with parental responsibility before treatment and before collecting health information, and for recording that consent, unless the young person is competent to consent themselves and you have judged that they are;
  • you will not enter into a client record any information you do not need, and you will keep it accurate;
  • you will respond promptly where we pass on a request from one of your clients to see, correct or delete their records; and
  • you will tell us without undue delay if you become aware of a breach affecting your clients' information.

9.4 Customer obligations

If you are a Customer, the information you give about yourself must be accurate, and where you give us someone else's details - an emergency contact, for example - you confirm they are content for you to do so.

9.5 International transfers and changes

Some of the providers we use are outside the UK. Our Privacy Policy lists them and the transfer safeguards we rely on. If a change in law requires a different mechanism, we may update our documentation accordingly without needing to change these Terms.

10. Disclaimers

The Platform is a booking and discovery service. We do not employ businesses, provide treatments, or guarantee outcomes. The relationship between customers and businesses is direct. We are not responsible for the quality, safety, or legality of services provided by businesses.

The Platform is provided “as is”. We do not warrant that it will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, we exclude liability for indirect, consequential, or special loss; loss of profit, data, or goodwill; and any claim arising from your use of the Platform or from services provided by businesses. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded by law (e.g. death or personal injury caused by negligence, or fraud).

12. Intellectual Property

The Platform, including its design, branding, and software, is owned by us or our licensors. You may not copy, modify, or use our intellectual property without permission.

13. Termination

We may suspend or terminate your account if you breach these Terms. You may close your account at any time. On termination, your right to use the Platform ends. Provisions that by their nature should survive (e.g. liability, indemnity) will continue to apply.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the “Last updated” date. Continued use after changes constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Scotland. The courts of Scotland shall have exclusive jurisdiction over any disputes, except where prohibited by law.
